Press release of the Friends of Refugee Solidarity in Solidarity International

26.3.2021

On the verdict of the Administrative Court of Stuttgart - made known by the PM of the Administrative Court of March 17th, 2021 - in the lawsuit Alassa Mfouapon against the state of Baden-Württemberg

The negotiation was accompanied by nationwide protests against the current refugee policy - not only against the renewed, partly completely incomprehensible and inhumane deportations of recent times, but also against the European refugee policy, which aims to expand isolation, deterrence and prevention of flight up to to "pushbacks" in the Mediterranean.

The lawsuit to establish the illegality of the police operation in the state initial reception center in Ellwangen (LEA Ellwangen) was upheld by the court in important parts: The judgment states that the police operation, insofar as it affected the plaintiff Alassa Mfouapon, was unlawful. However, since all residents of the state initial reception center were treated similarly that night, it would be common sense to conclude that the entire operation was illegal. The position of the lawyer and other courts in Germany that a room in a refugee accommodation is an apartment for which the protection of Article 13 GG applies to the inviolability of the apartment and therefore a search warrant according to clear criteria is required before a search , but the court rejected it. However, the appeal to the Administrative Court of Baden-Württemberg in Mannheim was allowed. This will continue to be argued in court.

Whether a refugee has the right to secure housing or not is also the subject of an urgent application by the Society for Freedom Rights (GFF) against the house rules of the initial reception facility in Freiburg at the Baden-Württemberg Administrative Court. She is suing together with Action to Stay in Freiburg, Pro Asyl, the Refugee Council of Baden-Württemberg and 4 refugees. Sarah Lincon, lawyer and procedure coordinator at GF, says: "There are few places in Germany where fundamental rights apply as little as in refugee accommodation. The state government is disproportionately restricting central rights in the facilities – and without any legal basis.”

The inhumane treatment of refugees must stop!

On the judgment of the Administrative Court of Stuttgart - announced by the PM of the Administrative Court of 17.3.21 - in the lawsuit of Alassa Mfouapon against the state of Baden-Württemberg

The hearing was accompanied by nationwide protests against the current refugee policy – not only against the resumed, partly completely incomprehensible and inhumane deportations of recent times, but also against the European refugee policy, which aims at the expansion of isolation, deterrence and prevention of flight up to "pushbacks" in the Mediterranean.

The court upheld the claim that the police deployment at the Ellwangen Initial Reception Center (LEA Ellwangen) was unlawful in important respects: The judgment states that the police deployment was unlawful as far as it concerned the plaintiff Alassa Mfouapon. However, since all residents of the Land First Reception Center were treated similarly that night, it would follow from this, according to common sense, that the entire operation was unlawful. However, the court rejected the lawyer's point of view, and also that of other courts in Germany, that a room in a refugee accommodation is a dwelling to which the protection of Article 13 of the Basic Law on the inviolability of the dwelling applies and therefore a search warrant according to clear criteria is required before a search. However, an appeal was allowed before the Administrative Court of Baden-Württemberg in Mannheim. This will continue to be argued in court.

Whether or not a refugee has the right to safe housing, among other things, is also the subject of an urgent appeal by the Society for Freedom Rights (GFF) against the house rules of the initial reception center in Freiburg before the Administrative Court of Baden- Wuerttemberg. It is suing together with the action to remain in Freiburg, Pro Asyl, the Flüchtlingsrat Baden-Württemberg and 4 refugees. Sarah Lincon, lawyer and procedural coordinator of GF, says: “There are few places in Germany where fundamental rights apply as little as in refugee accommodation. The state government is disproportionately restricting key rights in the facilities – and without any legal basis.”

The inhumane treatment of refugees must stop!

Elle poursuit l'affaire avec the Freiburg right to stay campaign, Pro Asyl, the Baden-Württemberg Refugee Council and 4 refugees.
