Constitutional complaint filed!

Alassa Mfouapon, Federal spokesman for the Friends of Refugee Solidarity, represented by the law firm Meister&Partner and in collaboration with the Society for Freedom Rights and Pro Asyl, filed a constitutional complaint. The inviolability of the apartment should also apply without restriction to refugee accommodation! The Friends of Refugee Solidarity stands for the slogan as a self-organization of refugees and people in solidarity “Now let’s talk” and in this sense has achieved important legal successes in the past, for example against the BILD newspaper or against Weidel/AfD because of their unbearable agitation.


The plaintiff emphasizes the importance of his lawsuit in view of Interior Minister Faeser's reactionary plans to tighten the legal situation: “She wants the police to be able to search various apartments and rooms in shared accommodation in the future - in other words, the integrity of the apartment is generally suspended in the event of deportations!”


The starting point of his lawsuit was the brutal police operation in 2018 in Ellwangen, Baden-Württemberg, where the police violently broke into the rooms of sleeping residents at night and caused fear and panic. Also as Alassa Mfouapon A few months later, when he was picked up for deportation, the police again entered the shared room in the state's initial reception center without paying any attention to the residents. His lawsuit is directed against this.

 To justify this he says: »Why can't the police knock on the door and wait for me to come to the door? Instead, she simply storms my room at night, without notice, without waiting for my reaction and, above all, without a search warrant. I would like the Federal Constitutional Court to make it clear in this important case that the rights of refugees count just as much as the rights of other people. We refugees also have an inalienable right to privacy. If the police want to break into our rooms, they should need a legally regulated search warrant, just like other citizens. There can be no exception for us. The inviolability of the home must apply to everyone, regardless of their origin or status," said Alassa Mfouapon
