Outrageous process: In the Alassa Mfouapon case, the state government is putting pressure on the administrative court in Sigmaringen!

On May 22, 2023, the regional council in Karlsruhe wrote a letter to the administrative court in Sigmaringen: "It is requested to notify whether in the above litigation (<a rel="noreferrer noopener" href="https://freunde-fluechtlingssolidaritaet.org/en/press-release-appeal-is-alassa-mfouapon-against-land-baden-wuerttemberg/" target="_blank">Appointment of Alassa M. in August 2021</a>) a decision can be expected in a timely manner. As far as possible, prioritization of the procedure is requested"

The Sigmaringen court replied: “AIn response to your request, we will inform you that a date for the oral hearing or a decision in the above-mentioned lawsuit is currently not yet foreseeable. Your request for prioritization will be noted and an appointment planned for the near future.” 

This correspondence was reported to the law firm Meister und Partner (lawyers of Alassa Mfouapon).

We sharply criticize the fact that the Karlsruhe regional council, as an authority of the state government that is not involved in the asylum procedure and has no rights in this respect, wants to influence an independent court. Because the asylum procedure is directed against the Federal Government of Germany, represented by the Federal Ministry of the Interior, which in turn is represented by the Federal Office for Migration and Refugees.

After the RP Karlsruhe had already failed with its clearly illegal attempt to replace Alassa Mfouapon's "residence permit" to which he was entitled during the ongoing asylum procedure with a "toleration", which means the possibility of deportation at any time, and following his protest with a "Error" has excused, is now also being unlawfully put under pressure on an administrative court that is "independent" by law! This cover letter cannot be interpreted otherwise!

The court responded to this - which is also unusual since the RP Karlsruhe is not involved at all in the asylum procedure. Although it has announced that no specific date is currently foreseeable, it has at the same time announced that an "imminent date" will be envisaged.

This is another scandal in Alassa Mfouapon's asylum procedure, which is aimed directly at him, his activities and those of the "Freundeskreis Flüchtlingssolidarität", whose nationwide spokesman he is.

The lawyer Roland MeisterWe have expressly objected to the actions of the Karlsruhe Regional Council and the behavior of the court and have also applied to the Regional Council for access to the files in order to investigate whether the case files contain further information on this reactionary approach, as planned by the Federal Government and at EU level against the background of the currently announced massive tightening of asylum and migration law.”

The events in Ellwangen and the attacks on Alassa Mfouapon were and are an expression of the reactionary asylum policy of the federal government and the red-green state government of Baden-Württemberg. The rejection of these attacks and the developing solidarity have contributed to the failure of Interior Minister Seehofer and his agitation. Essential components of his plans are now to be implemented by the new federal government in a new attempt.

 For this reason we call on you: participate and mobilize for the trial of Alassa Mfouapon against the state of Baden-Württemberg at the Higher Administrative Court in Leipzig on June 15th at 9:00 a.m.
